I have only been an author for 2 years now but I plan to write for many years to come. The subject I'm always drawn to is the Art of Meditation. I never took any interest in this until I had a first-hand experience with addiction in my previous years. I battled with addiction for some time without any positive outcome. I was then advised by a friend to try practicing basic meditation techniques, which then gave me the mental strength to quit my bad habits over time.

About A Critical Analysis of Judicial Appointments in India (with respect to Higher Judiciary)

In the current scenario, the Indian Judicial System is one of the strongest legal systems in the entire world. The appointment of the Judges, especially in the High Courts and the Supreme Court has always been in controversy as the appointment process have great implication on the independence of the judicial system. With an aim to secure the independence of the judiciary and high quality of judges, different schemes of judicial appointment have been endorsed.
Recently, the Parliament has passed National Judicial Appointment Commission Bill (NJAC), which will become operational once the essentiality of having assent of more than 50% of the states is achieved. There have been two different crucial phases in relation to judicial appointments before NJAC:
a) The period of appointments of judges in the higher judiciary by the executive i.e. from 1950 till 1993; and
b) The collegium mode of system of appointment of judges in the higher judiciary i.e. from 1993 till 2014.
The appointment or transfer of judges has always been a bone of contention between the executive and the judiciary. The Constitution of India authorizes the president to appoint or transfer judges ‘after consultation with the chief justice of India’, it was felt among the judicial class that mere ‘consultation’ did not ensure that the president would finally abide by the chief justice’s recommendations regarding appointments or transfers. The bitter experiences of the emergency period, when judges were selected on the basis of their political loyalty to the ruling Congress Party, alerted both the public and the members of the judiciary to the need for maintaining the independence of the judiciary through some infallible mechanism.
