About The IRA and Retirement Plan Owner’s Guide to Beating the New Death Tax by James Lange

Why the SECURE Act is so Devastating to IRA and Retirement Plan Owners
The ticking time bomb in the SECURE Act is the provision that radically modifies the required minimum distribution (RMD) rules for Inherited IRAs and retirement accounts. Subject to some exceptions, an Inherited IRA or retirement plan will have to be distributed and taxed within 10 years of the original owner’s death.

The only difference between those two scenarios is when the beneficiary pays taxes. The solid line represents the beneficiary who was able to stretch taxes over his lifetime under the old rules. Under the old law, using reasonable assumptions, the beneficiary of the inherited IRA would still have $2,236,583 when he is 86 years old. In sharp contrast, using identical assumptions, under the SECURE Act, the beneficiary would have $0.

Exceptions to the 10-year Provision in the SECURE Act
The law does not apply to:
• surviving spouses,
• non-spousal heirs who are not more than 10 years younger than the original IRA owner,
• children while they are still considered minors—after they reach the age of maturity, the 10 -year rule kicks in,
• beneficiaries who have chronic illnesses or disabilities, and
• charities, and charitable trusts.

Worthwhile Provisions of the SECURE Act
• The SECURE Act advances the required minimum distribution (RMD) to age 72 instead of age 70½.
• The SECURE Act also eliminates the age 70½ cutoff for making traditional IRA contributions and allows workers of any age to continue adding to their retirement savings.
• For many IRA owners, one of the best defenses against the death of the stretch IRA will be to complete a series of Roth IRA conversions, preferably during the years after they stop working but before they are required to take RMDs from their retirement plans.
• This will make it possible for working seniors to make IRA contributions and even more “backdoor” Roth IRA contributions, currently blessed by the Tax Cuts and Jobs Act. (With the backdoor Roth IRA technique you make contributions to a Traditional IRA because your income is too high for you to contribute directly to a Roth IRA. Then, assuming you do not have an existing Traditional IRA, you immediately convert the contribution you made to the Traditional IRA, to a Roth IRA.)
Beating the New Death Tax
• Though every taxpayer’s financial situation is unique, there are certain strategies that will help many IRA and retirement plan owners beat the new death tax. One of the common themes of these recommendations is “die with a reduced balance in your traditional IRA or retirement plan so it will not be clobbered with taxes so quickly after you die.”

Review Your Estate Plan Including Wills, Trusts, and the Beneficiary Designations of your Retirement Plan
• If you have any type of conduit trust in your existing estate planning documents, it may now do more harm than good. You should contact your attorney if your estate plan needs to be updated, because beating the new death tax could very well mean of hundreds of thousands of dollars to your heirs. We discuss both disclaimers and conduit trusts in greater detail in Chapter 2.
